The Sagamore Hills police were the first people I went to for help, in 2019. They came when I called, and on February 15, 2022 they arrested my ex-husband for domestic violence against me. What they wrote down, and what they didn't, mattered later. While a protection order covered my sons and me, my reports were logged, and the one investigation ended without a finding.
What happened
In 2019, I went to a Sagamore Hills officer about my marriage and "possible DV concerns." On September 21, 2019, after my husband took my phone so I couldn't call anyone, officers gave me "advice" and told me to go to a neighbor's. No report was written.
In May 2022, a court order protected my sons and me, and it directed that a copy go to the Sagamore Hills Police Department. The order barred contact with my sons' schools and child care providers, and it barred electronic surveillance. Police records confirmed a five-minute call from my ex-husband to my Younger Son's school two days after he was served. The report ends with the owner's word that it "had nothing to do with the kids." It records no finding, no charging decision and no explanation. My reports of tracking and phone tapping were logged as "information noted."
At a glance: 2019 DV concerns with no report · a call barred by the protection order, confirmed by phone records, then left with no finding · surveillance reports logged but never written up · "no victim rights were given" · body camera video marked "available," gone when I asked.
This page combines Sagamore Hills police reports and call logs (from my August 2024 public records request), the court orders, my emails with the department, and two of my own recordings. Officers are named only where they wrote or signed the record. I am not a lawyer; where I name a statute, whether it was broken is for a court or the proper authority to decide.
The orders the police were working under
| Dates | Order | What it said |
|---|---|---|
| Feb. 16 – Mar. 17, 2022 | Stow Municipal Court protection order (see Stow and Magistrate Collins) | Protected me. He could get his belongings only with an officer. |
| May 6, 2022 (file-stamped May 9, 8:02 AM) | Ex parte domestic violence civil protection order, DR-2022-05-1201, Magistrate Stephan Collins | Protected me and both of my sons. Among the checked terms: he "SHALL NOT INITIATE OR HAVE ANY CONTACT with the protected persons named in this Order or their residences, businesses, places of employment, schools, day care centers, or child care providers… directly or through another person" (¶6), and he "SHALL NOT use any form of electronic surveillance on protected persons" (¶7). I was named sole custodial parent (¶17). A copy was to be delivered to the "Sagamore Hills PD" (p. 6). |
| June 9, 2022 | Full protection order, Judge Susan K. Steinhauer (see Judge Steinhauer) | Protected only me, until June 6, 2023. |
The strongest issues
| Date | What happened | The record |
|---|---|---|
| Sept. 21, 2019 | Domestic violence concerns, and no report. I had gone to an officer about a month earlier about my marriage and possible domestic violence. That night my husband took my phone and left me no way to call anyone. Officers came and gave me "advice." No report number was assigned. Almost three years later, the June 8, 2022 custody order said my ex-husband "has had no other domestic violence issues either before or after 2/15/22." | Call log 1067254, coded "WELFARE CHECK": "FEMALE APPROACHED 0105 ABOUT A MONTH AGO ABOUT MARITAL ISSUES AND POSSIBLE DV CONCERNS AND SHE WAS GIVEN ADVICE… HE BECAME ANGRY AND TOOK HER PHONE AND LEFT HER WITH NO WAY TO CONTACT ANYONE… WAS TOLD TO GO TO A NEIGHBORS IF SHE NEEDS HELP." (Order of 6/8/22, DR-2022-03-0667, p. 11) |
| May 11 – 24, 2022 | A call to my Younger Son's school, confirmed and then left open. My lawyer brought the police phone records. They showed my ex-husband on a five-minute call with the owner of my Younger Son's school on May 11, two days after he was served with the order protecting my sons. The order barred contact with my sons' "schools, day care centers, or child care providers… directly or through another person." The report ends with the owner's account. The case status is blank, and the report records no finding, no referral to a prosecutor and no reason for not charging. | Incident 22-00116, "PROTECTION ORDER - CPO," Lt. Dan Rice, 5/24/22: my lawyer "was concerned that [he] already violated the CPO after he was served on May 9, 2022"; "according to phone records [he] spoke with Chris Lindley for 5 minutes on 5/11/2022 at 10:00am. Chris stated he did speak with [him], but the conversation had nothing to do with the kids." (Ex parte order, ¶6) See also The Goddard School. |
| May 6 and 12, 2022 | My surveillance reports were logged, not investigated. The night before I moved out, I told police that he watched the house and had cameras on it, and asked for an officer while I packed. On May 12, three days after he was served with an order barring electronic surveillance, I reported that he was tapping my calls, calling my son's school to find out where I was, and had a tracker on my phone. It was logged as "information noted." The log shows the dispatcher couldn't reach me again, and no officer's report followed. | Call 2222700, 5/6/22, 6:17 PM: "HER EX-HUSBAND… WATCHES THE HOUSE AND SHE IS AFRAID HE WILL SHOW UP… HAS CAMERAS MONITORING THE HOUSE." Call 2223849, 5/12/22, 9:14 PM, "INFORMATION NOTED": "SHE HAS AN ACTIVE CPO AGAINST HIM… HE HAS A TRACKER ON HER PHONE." (Ex parte order, ¶7) |
| May 7 and 9, 2022; Aug. 23, 2023 | "No victim rights were given." The report of the February 2022 arrest says I was given victim's assistance information. Four entries after that say none was given, starting with the next day's supplement, written when my ex-husband came to collect his things. | 22-00040 (2/15/22): "Victim's assistance information was provided to Careyann." Supplement, 2/16/22: "there was no victim rights information handed out." 22-00103 (5/7/22, Officer Glenn Lucore): "No victim rights were given." 23-00235 (8/23/23): "No victim rights were given." |
Other issues
- His garage door opener (May 9, 2022). In February 2022, when officers stood by while my ex-husband collected his things, "He also gave us the garage door opener, which we turned over to Careyann" (22-00040 supplement, Officer Ryan Shelby, 2/16/22). In May, the new order required him to surrender his keys and garage door openers within 24 hours. When he brought the opener to the station, he "WAS ADVISED THAT HE NEEDS TO CONTACT HIS ATTORNEY REF THE GARAGE OPENER AND THAT IT'S A CIVIL MATTER" (call 2223278, 5/9/22, 8:00 PM). To be fair, the order said to surrender them "to the law enforcement agency that serves Respondent," and I believe the Sheriff served him.
- Confirming where I was (May 7, 2022). The night before, I had told police that he watched the house and I was afraid he'd show up. While I packed with an officer in the driveway, a neighbor called him. He called the police, and they confirmed it: "I told [him] we were at the home regarding an escort with Careyann to retrieve her belongings" (22-00103, Officer Lucore, 5/7/22). The log of his call reads: "SPOKE WITH [HIM] ALL IS OK JUST HE SAID SHE SAID" (call 2222807). I had told the officer I'd filed for a protection order the day before. It hadn't been served yet.
- "Not a criminal matter" (May 9, 2022). At 9:30 that morning, about an hour and a half after the order protecting my sons and me was file-stamped, my ex-husband came to the station worried about where the boys were. The officer checked with my lawyer, called him to say the children were safe, and wrote: "This is a divorce and custody dispute, not a criminal matter… no victims assistance information was given" (22-00103, Officer Emily Roxbury, 5/9/22, 9:54 AM). His question that morning was a custody question. But the department's own records showed his arrest three months earlier for domestic violence against me.
- Body camera video. Reports 22-00040, 22-00103 and 23-00235 all say body camera video is "available." In August 2024 the records office told me arrest video is kept "until the court case has been closed" and call video "approximately 90 days." When I asked for the February 2022 arrest video in January 2026, I was told: "The Record Retention for videos is 90 days, then they are over written" (records office emails, 8/19/24 and 1/28/26). I am asking for the department's retention schedule.
- My 2025 report about his 2022 statement. On August 5, 2025 I went to the station to report that my ex-husband had given police a false statement in 2022. Two weeks later: "the time frame in which someone could be prosecuted for this is 2 years. That time frame has exceeded. Any false statements he may have made to the court, he would have to answer to the court" (Officer Shelby, email of 8/18/25, report 25-00201). Two years is the general limit for misdemeanors, so I list this for context, not as a failure.
- "That's your lawyer's issue" (September 5, 2025). The day my Younger Son's school kept me out on my ex-husband's word in spite of my decree (see Rushwood Elementary), I went to the station. The officer told me: "Well, that's not our issue. That's your lawyer's issue, not our issue," and "We don't take kids away from people. We just don't do that" (my recording, 9/5/25). That month I sent the department my decree and my reports of custodial interference by email. I have found no report number or outcome.
In fairness
- On February 15, 2022 they came when I called, arrested my ex-husband, and gave me victim's assistance information. The next day he "turned over ammunition to the PD per the protection order" (call 2207968).
- On May 4, 2022 an officer spent about half an hour with me about a possible tracking device on my car ("RP ASSISTED," call 2222286).
- On May 7, 2022 they escorted me while I packed, saw that my sons were "safe and well," and told my ex-husband the boys "were safe with their mother" when he wanted an Amber Alert and said they had been "kidnapped" (22-00103). At the May 20 hearing, Officer Lucore testified that no Amber Alert was needed and no kidnapping charge was filed.
- On May 19, 2022 Lt. Rice opened a protection-order file, met my lawyer and contacted both schools (22-00116). On May 23 they escorted my lawyer and me to the house.
- On February 20, 2023, when an exchange didn't happen, an officer called and my sons were dropped off more than an hour late (call 2308885).
- Officer Roxbury testified for me at the May 20, 2022 hearing (see Judge Steinhauer).
- On August 5, 2025 they took my report. An officer told me: "We can take a report from you, look into it, and then we go from there." I said, "You're like the first person in three years that said they will look into it" (my recording, 8/5/25).
The rules I'm pointing to
| Rule | What it says | Where it applies |
|---|---|---|
| R.C. 2935.032(D) | "A peace officer who investigates a report of an alleged incident of the offense of domestic violence or an alleged incident of the offense of violating a protection order shall make a written report of the incident whether or not an arrest is made." If arrest is the preferred course and the officer doesn't arrest, "the officer must articulate in the report a clear statement of the officer's reasons for not arresting." | 9/21/19 (DV concerns, no report); 5/12/22 (surveillance reported under an active order, "information noted"); 22-00116 (no finding, no stated reason) |
| Ex parte order, Form 10-C notice to law enforcement | If officers believe the respondent violated the order, "it is the preferred course of action in Ohio under R.C. 2935.03 to arrest and detain the Respondent/Defendant until a warrant may be obtained." | 22-00116 |
| R.C. 2919.27(A)(1) | "No person shall recklessly violate the terms of… [a] protection order issued… pursuant to section… 3113.31." | The 5/11/22 school call (¶6), the surveillance reports (¶7) |
| R.C. 2930.04(D) (current text) and Ohio Const. Art. I, §10a | At first contact with a crime victim, the investigating agency "shall provide the victim in writing, or provide access to" information on the victim's rights. | 2/16/22, 5/7/22, 5/9/22, 8/23/23 (no victim rights information given). The law was amended in 2023, so the 2022 wording may differ. |
What I'm asking for
- The disposition of incident 22-00116, and any referral to a prosecutor.
- Any record of the court-ordered delivery of my sons to the Sagamore Hills Police Department in June 2022. The order set a 5:00 PM June 13 deadline but wasn't entered until June 14 at 9:31 AM (see John Chapman). I have found no police record of it.
- The department's domestic violence policy under R.C. 2935.032 and its records retention schedule.
- Report numbers and outcomes for what I reported in September 2025.
