From December 2024 to October 2026 I asked the Summit County Prosecutor's Office, led by the elected prosecutor, Elliot Kolkovich, in writing and in person, to look at crimes in my custody case. I went to the office three times. I was told the office has nothing to do with filing charges, that a senior staff member was handling my matter and would call, and that I needed an appointment. On my third visit I was told it was "time for you to go." I have found no call, no appointment and no written reply to my emails.
What happened
On June 9, 2025, the Akron police sent me to the prosecutor's office to report perjury. The prosecutor's office told me, "We don't have anything to do with filing charges, and I cannot believe that they sent you here," and sent me back to the police. After the police took my report, I went back up, and was told the office "can't even see this report" unless the police file a charge. I was told a senior staff member would call me. A week later I was told he was "handling it." On my third visit, in August, I was told to make an appointment through the prosecutor's assistant. I sent the office eleven emails between February 2025 and October 2026, including requests for criminal charges and for a written acknowledgment. I have found no reply to any of them. On Facebook Messenger, when I asked the office in September 2025 to bring charges, its account told me to contact the police. I also reported that a sworn protection order petition against me, built around a 2024 campaign event the prosecutor attended, was false. His office told me he "does not particularly recall the evening." I have found no charge or decision (see below).
At a glance: sent from the police to the prosecutor and back on the same morning · "We don't have anything to do with filing charges" · a promised call I have no record of · three visits, no appointment, and "it is time for you to go" · eleven emails, no written reply · told by Messenger to go back to the police · a sworn petition about an event he attended, reported as perjury, with no decision I know of.
This page uses my emails to the office, my Facebook Messenger thread with the office's page, the Akron police report from June 9, 2025, and my own recordings of my visits on June 9, June 16 and August 5, 2025, which I transcribed. Only short quotes of what staff said are used, and staff are not named. The audio is not published. I am not a lawyer; where I name a statute, whether it was broken is for a court or the proper authority to decide.
The strongest issues
| Date | What happened | The record |
|---|---|---|
| June 9, 2025, late morning | Sent in a circle. I went to the Akron police to file a criminal complaint for perjury in my custody case. They sent me to the county building. A deputy at the door sent me up to the prosecutor's office. The prosecutor's office told me it had nothing to do with filing charges and sent me back to the police. The person at the desk apologized and said this happens "all the time." | My recordings, 6/9/25. Akron police: "You need to go to Summit County." Prosecutor's office: "You know what? And they do that all the time. I apologize." "We don't have anything to do with filing charges, and I cannot believe that they sent you here." "We get our cases from the municipal courts." |
| June 9, 2025, after the police report | "We can't even see this report." The Akron police took my report and my papers. I went back up and asked the office to review it. I was told the office would only see it if the police filed a felony charge, and that a senior member of the office would call me. The police report was marked "Complete" that day (see the Akron police page). I have no record of a call. | My recording, 6/9/25: "The police turns it into muni court first." "If it's a felony, it's transferred to us." "This report, we can't even see this report. The only way this report would be seen is if they filed a criminal complaint." "So he'll call you." Akron police report 2025-00065536, status "Complete." |
| June 9, 2025 and October 12, 2026 | The law lists the prosecutor as someone a citizen can bring a charge to. Ohio lets a private citizen who knows the facts file an affidavit charging an offense with a "reviewing official," and the prosecuting attorney is one of them. I was told the office has "nothing to do with filing charges." In October 2026 I asked the office in writing how to file that affidavit. I have found no answer. | R.C. 2935.09(A) and (D). My email of 10/12/26 asked for "Instructions for submitting a private-citizen affidavit under ORC § 2935.09(D)" and "Written acknowledgment of receipt." |
| June 16, 2025 | "Handling it." I went back and asked to speak to the prosecutor. I was told he was not available, that he had my information, and that a senior staff member was "handling it on Elliot's behalf." I was told I could email that staff member to check on progress. I asked for his email address. I have no record of receiving it, or of any update. | My recording, 6/16/25: "He wanted me to tell you that he has your information." "[He] is handling it on Elliot's behalf." "You're more than welcome to, you know, email him to check on the, the progress." |
| August 5, 2025 | "It is time for you to go." On my third visit I asked to be heard by the prosecutor and said I have a right to be heard under Marsy's Law. After taking my papers, the people at the office told me I needed an appointment and that it was time for me to leave. I said I had been calling for a month to get one. I was shown out. (I can't tell from the recording whether the people who asked me to leave were office staff or building security.) | My recording, 8/5/25, started 2:51 PM. Me, 01:27: "Under Marcy's law, I have a right to be heard by the prosecutor. He has to see me." 25:36: "And you need to make an appointment to see him." 25:38: "We've told you this before." 25:39: "So it is now time for you to go." 25:41: "And it is time for you to go." 26:01: "We'll talk to [his assistant], but it's time for you to go today." 26:46: "Okay, one more copy and then we got to go for the day." 28:04: "But we are done for the day. It's an office." 28:41: "Please go this way." |
| Sept. 15–16, 2025; May 18, 2026 | Sent back to the police, in writing. On Messenger I asked the office to bring charges for interference with custody and to issue a warrant. The office's account replied the next day with one line telling me to go to the police. In May 2026 I wrote back that the police say they can't act and the prosecutor has to. I have found no reply. | Messenger, office's page, 9/16/25: "If you believe a crime has been committed, please contact your local police or sheriff's office immediately." My message, 5/18/26: "Police say they can't do anything about it prosecutor has to act." |
| Feb. 2025 – Oct. 2026 | Eleven emails, no written reply. I asked for investigations of perjury and of interference with custody, asked for a reference number and written confirmation, and asked who to give my evidence to. I have found no written reply from the office to any of them. | My emails of 2/21/25, 6/9/25, 6/12/25, 6/22/25, 7/27/25, 8/7/25, 8/9/25, 8/10/25, 5/17/26, 6/2/26 and 10/12/26. My 6/2/26 complaint: "I respectfully request that this letter be assigned a formal case or reference number and that I receive written confirmation of receipt." |
Other issues
- My third visit, August 5, 2025. I was told the prosecutor had been away for more than three weeks and his staff were catching up, and that I should go through his assistant. I have no record of an appointment being offered afterward.
- Interference with custody. On June 12 and August 7, 2025 and June 2, 2026 I asked the office to bring charges under R.C. 2919.23 for my ex-husband keeping my sons from my court-ordered parenting time. On August 5, 2025 I was told to have the police document it and give the report to my attorney: "make a report on it and they will document it and then you can go ahead and submit that to your attorney." I was also told the office was not involved "because we have not received a criminal case" from the municipal court.
- Violating the protection order. My June 2, 2026 complaint asked the office to look at whether my ex-husband violated the 2022 protection order, based on the court's own written record of the May 20, 2022 hearing. I have found no reply. (The Sagamore Hills police page covers the reports I made to police at the time.)
Crimes reported in his county, not prosecuted: the candidate night
Separately from the visits above, I reported to this office that a sworn petition filed against me in the Summit County Court of Common Pleas was false. The petition was for a civil stalking protection order. It was built around an October 2024 campaign event that the prosecutor himself attended. His office told me in writing where he sat that night and that nothing about the evening stood out to him. I have found no charge, no written decision, and no referral to anyone else.
Her petition says the county's sheriff tried to get me to leave that night. No sheriff removed me or tried to remove me, and the records back me up.
| What she swore | What the records say |
|---|---|
| Her sworn petition, about the October 3, 2024 candidate night: "Sheriff Fatheree attempted to convince Carey Ann to leave, but she still wouldn't leave. Finally Sheriff Fatheree told her they were closing the building and she had to leave." | The community association that ran the event, 12/30/24: "there was no report filed for any incident or disturbance at this event." The prosecutor's office, after I asked whether he saw "Sherrifs attempting to remove someone from the building," 1/6/25: "he does not particularly recall the evening and nothing stands out about it from the other various campaign events that he attended this Fall." The association's own post the next day: "We had a great turnout for Candidates Night October 3, both candidates and residents." |
She signed that statement under the form's warning that false statements "may also subject me to criminal penalties for perjury under R.C. 2921.11." I reported it to this office as perjury. I have no record that the office reviewed it, and no charge was filed.
- October 3, 2024The G.R.I.D. Candidates Night was held at the Greenwood Village clubhouse in Sagamore Hills Township. The flyer lists Elliot Kolkovich (County Prosecuting Attorney) and Susan K. Steinhauer (Judge of the Court of Common Pleas) among the invited candidates. I was there. I brought a glass of water to the prosecutor and to my employer at the time, who was seated next to him. The next day the community association posted: "We had a great turnout for Candidates Night October 3, both candidates and residents." Flyer; association post, 10/4/24
- Late November to December 2, 2024Ms. Steinhauer was a lawyer in private practice by then, not a sitting judge. She petitioned for a civil stalking protection order against me under R.C. 2903.214 (Case No. CV-2024-11-5243). In the petition she gives her own account of the candidate night and of earlier matters, including the sworn sheriff claim quoted above, and she asks the court to order me to stay away from her. I deny her account of the candidate night. Above her signature, the petition form says: "I swear or affirm that the answers above are true, complete, and accurate to the best of my knowledge. I understand that making false statements in this document may result in a contempt of court finding against me which could result in a jail sentence and fine, and may also subject me to criminal penalties for perjury under R.C. 2921.11 …" A magistrate issued a temporary (ex parte) order on December 2, 2024, before I had a chance to be heard, and set a full hearing for December 16, 2024. Petition, Form 10.03-D; clerk's notice, 12/2/24
- December 16, 2024I missed the full hearing after mixing up its date with a hearing I had in another county's court, so my side and my evidence were not heard there. Protection order cases do not appear in the clerk's online case search, and I have not yet confirmed the court's ruling from a certified docket. Clerk's notice, 12/2/24; Summit County Clerk online search, 10/19/26
- December 30, 2024I asked the Greenwood Village Community Association for its records. Its manager wrote back: "I checked Greenwood's records for Candidate's Night held on Thursday, October 3, and there was no report filed for any incident or disturbance at this event." Email, 12/30/24
- December 30, 2024 to January 6, 2025I asked the office on Facebook Messenger about the evening, and specifically about the sheriff claim. The office wrote that the prosecutor "was seated next to [my employer] at the Greenwood candidate night this Fall" (1/2/25). I asked: "Did he witness any disturbance or incident that evening to where Sherrifs attempting to remove someone from the building? Or was it a relatively uneventful and peaceful night ?" The office answered on January 6, 2025: "I asked Prosecutor Kolkovich about that evening; he does not particularly recall the evening and nothing stands out about it from the other various campaign events that he attended this Fall." Messenger; screenshot, 1/6/25
- January 24 to March 26, 2025The same office represented Ms. Steinhauer, as the respondent, in my habeas corpus case about my sons (Case No. CV-2025-01-0029). It filed its notice of appearance on January 24 and a motion to dismiss on February 19. The court dismissed the case without prejudice on March 26, 2025. Clerk's docket
- February 17 and 20, 2025On Messenger I reported that the protection order petition claimed "things that never happened" and that I believed this was perjury. I asked: "So it looks like I have to file a police report with the details in order for it to come to your desk to review?" I have found no reply. Messenger
- June 9, 2025In person, I gave the office the case number and said I believed the petition was a third-degree felony under R.C. 2921.11, and that the prosecutor was a direct witness to the evening. I was told: "I can assure you that Elliott [Kolkovich]'s time that night was not focused on what you were doing." Then: "We'll get the protection order, see if we can find the police report, and then pass your information along," and "we will pass it on along to the powers that be that are above us." That day I emailed and messaged the office my evidence, including the petition. My recording; email and Messenger, 6/9/25
- July 27–28, 2025I filed a Citizen's Complaint under R.C. 2935.09(D) and 2935.10, with a copy to an office email address. It said: "False sworn statements were filed in support of a protection order application with no legal or evidentiary merit," and cited R.C. 2921.13 (falsification). Email, 7/27/25; complaint dated 7/28/25
- August 5, 2025On my third visit I said again that the prosecutor had been there that night. I was asked: "Honestly, do you know that he even saw anything?" My recording, 8/5/25
- As of October 2026I have found no charge, no written decision on my complaint, and no notice that it was sent to another prosecutor. My records
The office had its own elected prosecutor's account of the evening, the organizer's statement that no incident or disturbance was reported, and my sworn-petition complaint, which I raised in writing and in person over seven months. I have no record that the office acted on any of it or passed it to someone without a conflict.
In fairness: the candidate night
- A magistrate granted the temporary order, and I missed the full hearing, so no court has heard my evidence on the sheriff claim. No court or prosecutor has found that her statement was false, and I am not claiming a conviction or a court finding. I say it is false, and the records above support me. Deciding whether it was perjury is for a prosecutor and a court.
- "Does not particularly recall the evening" is not the same as "nothing happened." The prosecutor was a candidate at a busy event and may simply not have been watching. His staff made that point to me on June 9 and August 5, 2025.
- Jurisdiction. Greenwood Village is a neighborhood in Sagamore Hills Township, not a city or village. Misdemeanors in the township go to the Stow Municipal Court (R.C. 1901.02). For unincorporated areas, those cases are prosecuted by the law director of the city where the court sits, not by the county prosecutor (R.C. 1901.34(A)), unless the county has an agreement under R.C. 1901.34(D). I have not found one. The petition itself was signed and filed with the Common Pleas court in Akron. A knowingly false statement in it could be falsification, generally a first-degree misdemeanor handled in municipal court (R.C. 2921.13(F)(1)), or perjury, a third-degree felony (R.C. 2921.11). Felonies are the county prosecutor's to charge. So the part of my complaint that was clearly this office's to decide was the perjury claim.
- Under R.C. 309.08, the prosecutor "may inquire into the commission of crimes within the county." Whether to investigate or charge is the office's decision.
- The law makes the prosecutor the lawyer for county officers in suits over their official duties (R.C. 309.09(A)), so defending the habeas case was part of the office's job. Still, an office that is defending someone, and whose own elected prosecutor was at the event, has a reason to hand a criminal complaint about that person to someone else. I have no record that it did.
- My complaints often covered other matters as well. Within the office, my perjury claim may have been read as part of my custody dispute.
Marsy's Law
Ohio's crime victims' rights amendment, known as Marsy's Law, is Article I, Section 10a of the Ohio Constitution. I am a crime victim under it because of the February 2022 domestic violence case: the Sagamore Hills police arrested my ex-husband for domestic violence against me, and their report says "Victim's assistance information was provided to Careyann" (report 22-00040, 2/15/22). The court then granted me a domestic violence protection order in May 2022. That criminal case was handled in municipal court, not by this office.
The rights I asked the office to honor, word for word (Ohio Const. Art. I, §10a(A)):
- "(1) to be treated with fairness and respect for the victim's safety, dignity and privacy;"
- "(3) to be heard in any public proceeding involving release, plea, sentencing, disposition, or parole, or in any public proceeding in which a right of the victim is implicated;"
- "(4) to reasonable protection from the accused or any person acting on behalf of the accused;"
- "(8) to proceedings free from unreasonable delay and a prompt conclusion of the case;"
- "(9) upon request, to confer with the attorney for the government; and"
- "(10) to be informed, in writing, of all rights enumerated in this section."
Section 10a(D) defines a victim as "a person against whom the criminal offense or delinquent act is committed or who is directly and proximately harmed by the commission of the offense or act." On August 7, 2025 I wrote to the office asserting "The right to confer with the prosecuting attorney before any decision is made to not prosecute." On August 5, 2025 I was asked to leave the office. Whether these rights reach new complaints that no one has charged yet is a legal question I can't answer. I am asking the office to answer it in writing.
In fairness
- On August 5, 2025 I had come without an appointment and had been at the office for almost half an hour. Before asking me to leave, the people there took my papers, said "I will give this to him," and told me how to reach his assistant.
- The office's Facebook account did answer me: twice in January 2025 about the candidate night (see below), and once in September 2025. Its September answer, to go to the police, is the usual first step for reporting a crime.
- Marsy's Law rights mostly attach to proceedings "involving the criminal offense… against the victim." My February 2022 case was not this office's case.
- The staff I spoke with were polite. On June 9 the person at the desk apologized more than once for my being sent back and forth. On June 16 the person I spoke with said, "I'm not disagreeing with you that changes need to be made."
- What the office told me about how felony cases usually reach it, through a police charge and the municipal court, is a common way felony cases reach a county prosecutor in Ohio.
- Under R.C. 309.08 the prosecutor "may inquire into the commission of crimes within the county." Whether to investigate or charge is a decision the office makes.
- Interference with custody is usually a first-degree misdemeanor in Ohio. It is a felony only in certain cases (R.C. 2919.23(D)). Misdemeanors are generally handled in municipal court, not by the county prosecutor.
- Nine of my eleven emails went to an address I believed was the prosecutor's, but I have not confirmed that it is his. Only two went to addresses at the office. My visits were walk-ins without appointments.
- Several of my emails covered other matters as well, and some were long. The office may have answered me by phone or some other way I have no record of.
